By accessing or using the KayConnect platform, you agree to the terms set forth in this User Agreement. This document outlines your responsibilities as a user, our platform usage rules, billing terms, and legal limitations. It ensures a safe and transparent experience for all KayConnect users.
1. Acceptance of Terms
By creating an account and using KayConnect, you acknowledge and agree to comply with these Terms & Conditions. This agreement forms a legally binding relationship between you (the user) and KayKloud Pty Ltd.
2. Account Registration
- Users must provide accurate and complete information during sign-up.
- You are responsible for maintaining the confidentiality of your login credentials.
- Any unauthorized access or breach must be reported to support@kaykloud.com
3. User Responsibilities
- Ensure that the information uploaded is accurate and does not violate privacy laws.
- KayConnect must not be used for illegal, fraudulent, or harmful activities.
- You are responsible for maintaining the privacy of all data related to your students, trainers, and stakeholders.
4. Termination of Account
- KayKloud reserves the right to suspend or terminate accounts that violate our terms.
- You may request account closure at any time, subject to applicable data retention policies.
5. Platform Usage Policies
a. Permitted Use
- KayConnect is intended for use by training providers, coaches, and organizations to manage student enrollments, schedules, payments, and communication.
- Unauthorized modification, redistribution, or reselling of the platform is not allowed.
b. Subscription & Payments
- KayConnect operates on a subscription-based model with monthly and annual billing options.
- All payments are securely processed and are non-refundable unless explicitly stated.
- Billing disputes must be raised within 30 days of the charge.
6. Data Privacy & Compliance
- KayConnect complies with the Australian Privacy Act 1988 and the Notifiable Data Breaches (NDB) scheme.
- All user data is stored securely on Australian-based cloud servers.
- We do not share personal information with third parties without consent.
7. Intellectual Property Rights
- The KayConnect platform, its design, logo, and content are the intellectual property of KayKloud Pty Ltd.
- You may not copy, modify, or distribute platform materials without written permission.
8. Limitation of Liability
- KayConnect is provided "as is" and does not guarantee uninterrupted service.
- KayKloud Pty Ltd shall not be liable for any data loss, business disruption, or indirect damages.
9. Changes to Terms & Conditions
- These terms may be updated periodically.
- Users will be notified of significant changes via email or platform notification.
