This User Agreement (“Agreement”) governs your access to and use of the KayKloud platform.KayFinder is KayKloud’s training discovery platform used by learners and communities to discover training providers.KayConnect is KayKloud’s training management platform used by organisations to manage their information, including details that appear on KayFinder.This Agreement applies to you based on how you access or use the KayKloud platform.
This Agreement constitutes a legally binding relationship between you (“User”) and KayKloud Pty Ltd.
Users must provide accurate, current, and complete information during registration.
You are responsible for maintaining the confidentiality of your login credentials.
Any unauthorised access or suspected security breach must be reported immediately to kaysupport@kaykloud.com
Ensure that any information submitted or managed through the platform is accurate and lawful.
Do not use the platform for illegal, fraudulent, or harmful activities.
Training providers are responsible for safeguarding the privacy of all data relating to students, trainers, parents, and other stakeholders.
KayKloud may suspend or terminate access where this Agreement is violated.
You may request account closure at any time, subject to applicable legal and data retention obligations.
Accounts with no meaningful activity for 90 consecutive days may be archived and access temporarily restricted. Archived accounts may be reactivated by signing in again or contacting support.
Accounts that remain archived and inactive for 180 consecutive days may be permanently deleted, subject to applicable legal and regulatory requirements.
KayKloud is not liable for data loss resulting from account deletion due to prolonged inactivity.
- KayFinder is intended for discovering training providers and training opportunities.
- KayConnect is intended for use by training providers and organisations to manage enrolments, scheduling, billing, attendance, and communication.
- You must not modify, resell, reverse-engineer, or misuse the platform or its content.
KayConnect operates on a subscription-based model with monthly or annual billing options.
All payments are processed securely.
Fees are non-refundable unless explicitly stated otherwise.
Billing disputes must be raised within 30 days of the relevant charge.
- KayKloud complies with applicable data protection laws, including the Australian Privacy Act 1988 and the Notifiable Data Breaches (NDB) scheme.
End-user data is stored securely in regionally hosted cloud environments, aligned with applicable data residency and privacy requirements.
KayKloud does not sell or share personal information with third parties without lawful basis or user consent.
- All intellectual property related to the KayKloud platform, including software, design, branding, logos, and content, is owned by KayKloud Pty Ltd.
You may not copy, modify, distribute, or create derivative works without prior written permission.
- The platform is provided on an “as is” and “as available” basis.
KayKloud does not guarantee uninterrupted or error-free operation.
To the maximum extent permitted by law, KayKloud Pty Ltd is not liable for indirect, incidental, or consequential damages, including data loss or business interruption.
- KayKloud may update this Agreement from time to time.Significant changes will be communicated via the platform or email. Continued use of the platform constitutes acceptance of the updated terms.
